Who this release is given to
Triple "T" Enterprises, Inc., The Peak Fly Shop and Peak Fly Fishing Outfitters (Colorado Outfitter #2308), 5632 North Academy Blvd, Colorado Springs, Colorado 80918, County of El Paso, State of Colorado.
Assumption of risk
I, the releaser, understand that during the guided trip, class or private instruction that I participate in under the arrangements of Peak Fly Fishing Outfitters, and its agents, guides, contractors or associates, certain risks and dangers may arise, including but not limited to the hazards of river and stream wading, boating, float tubing, potential fishing hook impalement, travel by bus, automobile or other means of travel, the forces of nature and accident or illness in remote areas without means of rapid evacuation or medical facilities.
Release
In consideration for participation of, and as a part of the payment for the right to participate in guided fishing trips, classes, or private instruction or other services arranged for me by Peak Fly Fishing Outfitters, and its agents, guides, contractors or associates, I have and do hereby assume all the above risks and will hold them harmless from and defend them against any and all liabilities, actions, causes of action, suits, debts, demands and claims of every kind and nature whatsoever which I have or which may hereafter arise out of or in connection with my trip or participation in any other activity arranged for me by Peak Fly Fishing Outfitters, and its agents, guides, contractors and associates.
Agreement
I have read and agree to all conditions stated in the Release and Assumption of Risk. A member of the party 18 or older must fill in the information above and sign and date below. Additional members of the same party are required to read the Form, sign and date below. Names and information for those under 18 must be filled in and the form signed and dated by parents or legal guardians. This release contains the entire agreement between the parties hereto and the terms of this release are contractual and not a mere recital.
Trip Agreement
This is the agreement between Cole Atchley Fly Fishing and the client(s) named below for a guided fly fishing trip in Colorado. Trips are outfitted through Peak Fly Fishing Outfitters (Colorado Outfitter #2308), whose Release and Assumption of Risk above forms part of this agreement.
The day
No more than three anglers fish with one guide, though larger parties can be arranged. A half day runs four and a half hours and a full day runs six, starting at a time agreed in advance — early mornings are usually best. The meeting place is agreed with you when the trip is booked.
What is provided, and what is not
Waders, wading boots, rods, reels and flies are provided at no charge. Lunch is included on full days. Clients provide their own transportation unless arranged in advance, and are responsible for purchasing any required fishing licenses, permits, or land usage fees (rod fees).
Deposits and cancellation
Half the trip rate is taken as a deposit and holds the date. Cancel a week or more before the trip and the deposit is returned in full. Weather on a Colorado river cannot be predicted a week out; if the water blows out or conditions turn unsafe, the trip is rescheduled rather than lost.
